Philip Glass Sues Producers of Conservative Film Over Ad Music

By Ben Mattison
22 Oct 2004

Composer Philip Glass has filed suit against the producers of the film Celsius 41.11, claiming that they used his music in ads for the film without his permission, the New York Times reports.

The film was produced by Citizens United, a conservative group, and is intended as a response to Michael Moore's anti-Bush documentary Fahrenheit 9/11. According to Glass, music from his score for the 1987 film Powaqqatsi is heard during the ads.

David N. Bossie, the president of Citizen's United, told the Times that the music in question was not by Glass but by a different composer, Walter Heinisch, and that it was used with permission. Bossie added that he suspected that Glass, who contributed music to a film about Democratic presidential nominee John Kerry, was driven to file suit by political ideology.

Glass's lawyer, Timothy O'Donnell, said that Glass was entitled to decide how his music was used. "Philip Glass is passionately opposed to the agenda of this partisan organization and he does not want his music used to promote that agenda," he said.

O'Donnell said that if Glass's music is in the film itself, he would consider asking a judge to prevent it from being shown.
